LAWS DEALING WITH THE USE OF WIRELESS TELEPHONES AND ELECTRONIC WIRELESS COMMUNICATION DEVICES WHILE DRIVING IN CALIFORNIA

Effective July 1, 2008 for wireless telephones

For drivers 18 and older (Vehicle Code 23123):

  • This law is considered a primary offense, and you can be pulled over for using a wireless telephone.
  • It is legal to use a Blue Tooth headset or other hands-free device, but you cannot have both ears covered.
  • It is legal to use the speaker telephone function of your wireless telephone while driving
  • It is not legal to use the "push-to-talk" function of your wireless telephone while driving, unless attached to a hands-free device.
For drivers under 18 (Vehicle Code 23124):
  • Drivers under 18 may not use a wireless telephone, pager, laptop, or any other electronic communication device to speak or text while driving, even if it is hands-free.
  • The use of a handheld wireless telephone while driving is a primary offense, and you can be pulled over.
  • The use of a hands-free device while driving is a secondary offense. A law enforcement officer may cite you for using a hands-free device if you are pulled over for another violation.

Both laws allow for the use of wireless telephones to make emergency calls to law enforcement agency, medical provider, the fire department, or other emergency services agency.

No-Text Law Goes Into Effect January 1, 2009

Starting January 1, 2009 a new law will go into effect where writing, sending, or reading a text-based communication while driving will be against the law for all drivers in California.

This new law applies to electronic wireless communications devices used to manually communicate with any person using text-based communication, including, but not limited to, communications referred to as text message, instant message, or electronic email.

Violating this law is punishable by a base fine of $20 for a first offense and $50 for each subsequent offense. With the addition of penalty assessments, fines can be more than triple the base fine amount.
